put in so much work over such a long time um I think that probably both sides have ruled out a first-degree murder conviction that’s probably not going to happen here uh an example of first-degree murder would be the shooting of the insurance executive in New York where it was completely planned out uh and just the the the shooter’s motives you could you could tell just from his actions so that’s probably not going to happen I think both sides are talking about or thinking there’s going
to be perhaps a second deegree murder or voluntary man law or an acquittal and would those be considered victories in the eyes of a defense attorney well I think a voluntary manslaughter would be I think under these circumstances there’s a determined sentence you know could be anywhere from 6 to8 years or less um and so um that probably if I was the defense attorney you know that wouldn’t be a bad resolution second degree murder carries a 15 to life and um brought probably the defense would not be happy with that uh
as you were watching the trial I know you saw Nemo M meni take the stand was often combative with the prosecutor what’s the risk of putting a defendant on the witness stand and and do you think it was an effective decision well I didn’t like the part about him being combative with the prosecutor and um you know that sure shows that he you know could be an angry person he’s already sort of a big guy husky guy and so uh when when I put my clients on the witness stand I prepare them really well you know and tell themnot to argue with the prosecutor uh just to answer the questions straight away and I’m very careful about who I put on the witness Dan some some clients are just they’re they’re not they’re going to uh not help their their cause um so I like the fact that they put him on I don’t like the fact that he was combed with the prosecutor would you have still put him on so the juries really want to he from the defendant um and he was the only one there uh there were no other witnesses
around there really was no clear video of what happened so um I I still like the fact that they they put him on and and you know there was a lot of discussion in the Jury Room about his testimony that was proba perhaps that was you know the majority of the discussion as to what he said were there any moments where you thought the prosecution or the defense scored a victory in the courtroom well I I think that um putting on Bill Lee’s friend uh with who talked about the the the telephone phone call that
happened before where Rino was very angry that could show Motive for the killing so I thought that was a very important part of the case and um good for the prosecutors to put that to put that evidence in um on the other hand there was so much drug use um during the day 24 hours before the killing you know that that really sort of put um the deceased the victim in a bad light and perhaps that showed that you know per perhaps that you know that he was aggressive and in the final moments of his life with M all right all
