hello my name is Chris Morales I’m a criminal defense attorney in San Francisco California I’m a board certified specialist in criminal law today we’re going to be talking about gaining or getting monetary damages there money if you are the victim of a theft if you are the victim of a theft and the perpetrator or the thief sold the things that he he or she took from you to another party that party can be on the hook or responsible for paying you triple damages for the amount of your loss
and in other words let’s say you lost one hundred thousand dollars and this person the the defendant in the criminal case was convicted of possessing that stolen property even if it’s cash that person could be liable for paying you back the hundred thousand dollars that they stole plus triple those damages or another three hundred thousand dollars for a total of four hundred thousand dollars now the key to this is in Penal Code section 496 subsection C and if the perpetrator or the thief is also
convicted of being a being in possession of stolen property then that triggers the triple damages sometimes the thief and the possessor of stolen properties is the same person that makes it easy and sometimes the thief sells or gives the stolen property or money to a third party and that party is on is on the hook the good thing about Penal Code section 496 C you don’t actually have to have a criminal conviction in order in order to collect the triple damages a civil judge can declare somebody is
