California Warrants

With a warrant an officer can search your car, home and other locations they suspect. Before allowing any authorities to search your home or car one must make sure it is a valid search warrant.

A valid search warrant will contain a signature of the approving judge and should include your name, a specific location, and the “probable cause” of the warrant.

For a judge to take such precautions she/he must believe:

-That a crime has been committed

-That evidence of that crime is likely to be found in the place described in the search warrant

There are different types of warrants that can be issued in the state of California. A California arrest warrant is issues when criminal charges have been filled. This warrant allows police officers to arrest the specific individual facing charges. A California bench warrant is when a judge issues a warrant for violation of a rule of court for example failing to appear in one’s court hearing.

Before a search warrant begins the officer handling the warrant must execute these four procedures.

–          Office must knock on the door

–          Officer must announce him/herself as a law enforcement officer

–          Officer must Inform the occupant that he/she has a search warrant

–          Officer must give the occupant enough time to open the door

It is important for one to know their rights. The fourth amendment in the United States Constitution protects individuals from unlawful search and seizure. You can protect yourself from officers barging into your home in search of illegal activity without if there is no search warrant. One’s case can be affected by warrants.
